Miller trial postponed as new evidence is accepted

The jury trial for Robert Miller's involvement in the murder of Tynce Joles was set to begin Monday, but has now been put on hold.

According to Bourbon County Court documents, the request by Miller's attorney, Charles O'Hara, to postpone the trial due to new evidence was accepted Friday. The results of a DNA test were given to Bourbon County Attorney Terri Johnson who also provided the results to O'Hara. The postponement request was approved by District Judge Mark Ward because the results of the test is believed to be "significant" and could "effect the jury trial," according to court documents.

Johnson, O'Hara, and Ward met via a phone conversation Monday morning and rescheduled the trial for November 15. The trial is scheduled to begin at 9 a.m. and five days have been allowed for the trial.
