Fort Scott man awaits transport to state prison after being found guilty of sex crime against 13-year-old child

Matthew R. Sisney awaits transport to an undisclosed Kansas Department of Transportation facility after a judge sentenced him to seven years in prison for enticing a 13 year old girl to have sex with him last year.

Bourbon County District Judge Mark A. Ward sentenced the 19 year old on April 17 to 85 months on two felony counts of aggravated indecent solicitation of a child. The judge gave Sisney 51 months on count one and 34 months for count two. The two counts are slated to run consecutively.

Ward sentenced him to the "aggravated" sentence or maximum term that's determined by the Kansas Sentencing Guidelines.

The guideline is determined by the severity of the felony and criminal history of the defendant. In this case, Sisney committed the crime while on probation for a previous sentence in Vernon County, Mo., in 2006, according to court records.

Sisney also must register as a sex offender, pay $163 in court costs, and be under 2 years of post-release supervision.

Even though he was sentenced to 7 years in prison, Sisney will get credit for the 361 days he's served in the Southeast Kansas Regional Correctional Center since he was arrested on a warrant by Fort Scott Police last May.

In February, Sisney pleaded guilty to the two counts of indecent solicitation, which is classified as intentionally enticing or soliciting a child under 14 years-old to commit or submit to an unlawful sexual act. No details were released as to exactly what act was performed. The crimes happened last April 2 and April 28 at an apartment complex at 101 S. Andrick St. in Fort Scott that Sisney was living in.

His arrest culminated from a report FSPD received from Social Rehabilitation Services. SRS case workers and police investigated the allegations.

Sisney was originally charged with three counts of rape, but the plea bargain, reduced those charges to indecent solicitation.
